Terms of Service

1. Agreement
By creating an account or using ScrapDesk ("the Service"), you agree to these Terms of Service. If you are using ScrapDesk on behalf of a company, you represent that you have authority to bind that company to these terms. These terms are governed by the laws of Western Australia, Australia.
2. The Service
ScrapDesk provides cloud-based business management software for the recycling and materials recovery industry. We provide the platform; you provide the data and business operations.
3. Account & Security
- You are responsible for maintaining the security of your account credentials
- You must be 18 or older and legally authorised to operate a business in Australia
- One account per business entity (additional users may be added)
- Notify us immediately of any unauthorised access: security@scrapdesk.com
4. Trial & Pricing
- New accounts receive a 30-day free trial with full access to all features
- No credit card is required during the trial period
- After the trial, a subscription is required to continue accessing the Service
- Current pricing is published at scrapdesk.com/pricing
- Prices are in Australian Dollars (AUD) and are inclusive of GST
- 30 days notice given before any price changes
5. Your Data
- You own all data you enter into ScrapDesk
- We do not claim any rights over your business data
- You can export all your data at any time from Settings
- We will not use your business data to compete with you or share it with competitors
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Australian law
- Attempt to gain unauthorised access to other users' data
- Reverse engineer or copy the Service
- Use the Service to store content that infringes third-party rights
7. Uptime & Support
- We target 99.5% uptime, excluding scheduled maintenance
- Support is available at support@scrapdesk.com
- Critical issues are addressed within 4 business hours (AWST)
8. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, ScrapDesk's total liability to you for any loss or damage arising from the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect or consequential losses, loss of profit, or loss of data (please maintain regular backups using our Export function).
Nothing in these terms limits rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010), including guarantees that cannot be excluded.
9. Termination
- You may cancel your account at any time from Settings with no penalty
- We may terminate accounts that violate these terms, with 14 days notice where practicable
- On termination, you have 30 days to export your data before it is deleted
10. Governing Law
These terms are governed by the laws of Western Australia. Disputes shall be resolved in the courts of Western Australia, Australia.
